Whether this caused by the actions of the neighboring buildings, units within the same complex, construction, renovations, mandatory repairs, public service workers or unforeseen circumstances in the surrounding area, NO refunds, reimbursements, discounts or future credits can be issued. This would also include and is not limited to the closure of condo common areas for upgrades and / or repairs. These situations are completely beyond our control and are the result of robust and growing communities.

Due to the continued and constant investment, growth, upgrades and renovations in Puerto Vallarta, from time to time there may be a minor interruption of public services including hydro, water or sewer or the lack thereof. Although this is not a common problem in PV, it can happen.

Property Policy


- ALL properties represented by PVRPV are NON SMOKING this includes; patios, terraces, outdoor spaces attached to or a part of a Vacation Rental Property - if smoking takes place inside the property – you will be obligated to pay, a fine, an extra cleaning fee and you may be evicted.

- Clients shall not remove any item/s from the property, such as kitchen appliances, glassware, furniture, or any other item.

- The use and enjoyment of the property does not include illegal activities such as the use of illegal drugs, prostitution, selling of goods (illegal or otherwise) and/or kidnapping, this is strictly prohibited.

- Excessive noise that may affect neighbors will be strictly sanctioned as per the local building rules and regulations established by the property that you are occupying.

- PVRPV guests and/or the visitors of the guest(s) are responsible to adhere to the rules, regulations and polices of PVRPV and/or the individual property policies thereof. Failure to obey the rules and policies established will be asked to vacate the property without the right to any refund.

The responsibility to know or adhere to the policies, rules or regulations are the responsibility of the guest.

THIS IS A SMOKE FREE RESIDENCE
It is not allowed to smoke in any of the areas of the residence.

OCCUPANCY POLICY
Maximum occupancy of 4 people.

VISITOR POLICY
Only guests registered and confirmed in your booking are allowed to occupy the unit.
The number of persons stipulated on the guest’s Booking and the confirmation email is the maximum number of people allowed to stay at the vacation property. If more guests arrive to stay / occupy than stated on the Booking Confirmation, they may be denied occupancy. In the event they are permitted to check-in an extra charge may apply.
No overnight visitors are allowed.

PET POLICY
Pets under 12kg are welcomed in the unit, please consider a $500 USD deposit (CASH) is required upon arrival and returned upon check-out after an inspection and no damage in the unit.
Pets are not allowed in common areas.

NOISE RESTRICTIONS
NO HIGH VOLUME or NOISE AFTER 10:30 PM: Including Radios, Stereos, Music, Televisions etc.

POOL POLICY:

The use of the pool is under your OWN risk.

The swimming pool is the most demanded amenity, and consequently, it is the most likely source of conflicts. Given its small size relative to the condominium's population, all users are encouraged to strictly adhere to the regulations and exercise common sense and good judgment.

The swimming pool is exclusively for condominium owners and their guests. In the absence of the condo owner, notification to the administration is required, either in person or by phone, at least one day in advance. The total number of people, including the owner, guests, minors, and adults, must not exceed 10 in total per condo owner. The pool is for recreational use only, and only condominium residents (owners or tenants) are permitted to take lessons; inviting outsiders to lessons is not allowed.

The pool can be used from Sunday to Thursday between 8:00 AM and 10:00 PM, and on Fridays and Saturdays between 8:00 AM and 11:00 PM, with the same noise restrictions as the terrace. Pool use is also allowed after 10:00 PM until 2:00 AM, provided there is no noise, disturbance, laughter, or any other activity that may disturb neighbors. Users are responsible for the proper use of facilities and furniture.

The use of sunblock and any other creams that may harm the pool water is strictly prohibited. Users must shower before entering the pool. Swimwear is mandatory for pool use, and entry in inappropriate clothing such as shorts, pants, skirts, etc., as well as nudity, is strictly forbidden. Babies must use appropriate swim diapers.

Minors and babies are not allowed in the pool without adult supervision. Small toys, balloons, inflatables, or any other objects that may obstruct other users or endanger the pool's operation are prohibited unless specifically designed to ensure safety. Users of the pool do so at their own risk, and the condominium is not responsible for accidents. Damages caused to pool furniture by condo owners and their guests are the responsibility of the condo owner.

Food and glass containers are not allowed in or around the pool area. Sound devices can only be used at a moderate volume and only during pool hours. Bicycles, skates, strollers, and any toys, vehicles, or devices that may endanger pool users are prohibited from being used around the pool. Discarding cigarette butts, chewing gum, or any trash inside or outside the pool area is strictly prohibited. Animals are not allowed in or near the pool area. Users are urged to refrain from using offensive language, and repeated offenses will be penalized according to their severity. Pool furniture should not be moved from its designated location, and it should only be used for its intended purpose. Trash must be properly disposed of in the bins located on the terrace.

Users are kindly requested to collect their belongings both inside and outside the pool area. The administration is not responsible for losses or damages. The maximum occupancy per villa is 10 people, including children and adults, taking into account the villa owners. This does not mean that all of them can be in the pool simultaneously if other condominium owners wish to use it.

Playing with balls or other objects inside the pool when other users are present or when someone wishes to enter the pool is strictly prohibited. Condominium owners are obligated to inform their guests of these regulations and monitor their behavior during their stay in the condominium. If an owner has guests who intend to use the common facilities without their presence, they must notify the administration, providing the names of each guest, entry date, and authorized departure date. Otherwise, access to the pool, terrace, and gardens may be denied.

GUEST KEYS POLICY

You will be issued 1 set of keys for each person noted on the Booking Confirmation. Keys must be returned in the same condition as received at the time of Check-Out.

PLEASE NOTE: Should you lose, damage or not return a set of keys the cost is $1,000 pesos for each key. Please have this fee prepared to be collected by the concierge at the time of check-out (CASH ONLY). This Fee is NOT covered by the guest damage insurance.

Regulations for Villas Boccanera

In order to maintain the cleanliness and comfort of other property owners, it is mandatory to exhibit appropriate behavior by both residents and their family members, visitors, and any staff in their service. The use of common areas is exclusively reserved for condominium owners. Tenants or guests of condominium owners may also use these areas, but only with express permission from the owner, subject to the conditions outlined in these regulations.

It is strictly prohibited for anyone not associated with the condominium to enter without authorization from a condo owner. The owner who provides this authorization is responsible for the behavior and adherence to the regulations of their guests, along with all obligations and commitments that may arise.

No guest has the authority to invite third parties into common areas; entry permission is solely the prerogative of condominium owners, who are responsible for ensuring that their guests or tenants comply with the regulations.

To ensure the proper maintenance and preservation of facilities, furniture, equipment, and all other assets that constitute the condominium's patrimony, any damages resulting from misuse must be covered in full by the responsible party. In the case of family members, guests, or tenants, the condo owner is held accountable.

Terrace

The terrace may be used by condominium owners, tenants, and/or guests from Sunday to Thursday between 8:00 AM and 10:00 PM, and on Fridays and Saturdays between 8:00 AM and 11:00 PM. It is imperative to avoid disturbing other residents with noise, music, or any other form of disturbance. Additionally, the terrace can be used after 10:00 PM and until 2:00 AM, provided there is no noise, disturbance, laughter, or any other activity that may disturb neighbors.

Green Areas

Green areas encompass all areas within the condominium, starting from the property boundaries of each private unit. These areas may be used by condominium owners, tenants, and guests exclusively for pedestrian traffic, relaxation, and recreational activities. Using the green areas as sports fields for activities such as soccer, baseball, American football, and any sports that may jeopardize the physical integrity of people in the area, as well as causing damage to trees, ornamental plants, condominium facilities, vehicles, or neighboring houses, is strictly prohibited. Playing ball games is allowed only with a soft plastic ball, not actual balls, in the common area adjacent to Villa 16, and only in moderation to avoid accidents. The hours for ball games are from 10:30 AM to 8:00 PM, seven days a week. The administration is not responsible for any breakages of glass, paint, or other damages caused by these activities. Parents and responsible condo owners for these actions must cover the costs or repairs necessary to fix any damage caused to neighbors or common condominium areas.

Roadway

The entry and circulation of vehicles on the interior street of the condominium will be for the exclusive use of its residents. A maximum of 3 vehicles per villa is allowed (two inside and one on the side of its garage), avoiding interference with the free flow of cars on the street and pedestrians. Parking on the yellow line located next to the common area is prohibited.
To prevent disturbances from vehicle noise and avoid contamination from carbon dioxide and carbon monoxide, unnecessary acceleration of vehicle engines, motorcycles, or any other type of motor is not allowed.
The pedestrian entry of individuals not belonging to the condominium will be controlled with official identification, subject to the authorization of each condo owner to visit.
Pedestrian entry through the administration office access for condo owners and visitors prohibits the use of the electric gate, for pedestrian entry and exit, you must always use your key for the pedestrian gate, otherwise, you may be subject to a fine.
Visitor-owned cars must be parked outside the condominium, respecting the spaces in front of external houses, and parking is allowed starting from the office onward.
It is prohibited for both condo owners, guests, family members, etc., to block garages or enter other people's garages without prior written authorization from the villa owner.
The maximum speed for cars and motorcycles is 10 km/h. It is the responsibility of all condo owners, as well as their family and friends, to respect this limit.
Vehicles should not be permanently parked in common areas and circulation areas that obstruct passage.
Do not obstruct gardens, streets, walkways, and other access roads in the condominium with articles or objects.

Pet Ownership and Control

Only villa owners have the right to have pets, as long as they are domestic animals (dogs, cats, birds, or other animals that are not wild or prohibited by SEMARNAT) and do not pose a threat or danger to people, property, villas, and common areas. Pets are not allowed for renters.
All pets entering the condominium, whether temporarily or permanently, must be registered with the administration. In the case of dogs and cats, they must wear identification collars and be vaccinated.
Pets can only leave their villas accompanied by their owners, who must have them on a leash, ensuring they do not cause damage to others' property, and picking up any fecal matter and disposing of it in the appropriate garbage container.
Under no circumstances are pets allowed on the terrace, green areas, and especially not in or near the pool.
Areas designated for pets must maintain proper hygiene conditions to avoid health problems and unpleasant odors that may disturb neighbors.
Any pet found in the common areas of the condominium without its owner will be reported to the owner first. In the case of a repeat offense, it will be removed from the condominium by specialized personnel. If a loose pet is found within someone else's property, the owner of that property must report it to the administration, which will warn the pet owner that, in case of a repeat offense, their pet will be expelled from the condominium, and a fine will be imposed.
Pet owners will be responsible for any damage caused by their pets and must cover all necessary expenses and repairs.
If a pet attacks a person or another neighbor's pet, in addition to the penalty and payment of expenses, that pet must be permanently removed from the condominium.

General Matters

It is prohibited to store items in the garage that give a bad appearance to the condominium, such as tires, batteries, refrigerators, machines, or similar items.
Each condo owner is obligated to maintain the conservation and operation of the services and installations of their private unit, and the repair of their equipment and installations is their responsibility.
The installation of signs, tables, chairs, or exhibitions, display signs, and the like is permanently prohibited, whether in units of private ownership and/or common areas.
When using trash containers, bags should be closed and properly placed inside the garbage containers located outside the condominium.
Do not store inflammable, dangerous materials or anything that could represent a threat to the safety of the complex or its occupants. In case of an incident of this nature, the responsible party must cover the total cost and repair to their property, third parties, and common areas.
Immediate notice should be given to the administration of any material damage caused to common property or any anomalous situation that violates these regulations and may affect future common interests.
Hanging clothes, towels, rugs, underwear, swimsuits, etc., on balconies, windows, and common areas is strictly prohibited.

Visitors

All condo owners, and in their case, tenants, are obligated to report and register in advance, at least one day in advance, all visitors who will or intend to use common areas such as the terrace, pool, or green areas. They must provide the names and the days they will be using these common areas. In cases where the administration is not informed, it may deny access to the facilities, as these individuals may be outsiders or unauthorized to be within the condominium.
The entry of all visitors will be controlled with official identification and will be subject to the authorization of each condo owner to visit.
Visitor-owned cars must be parked outside the condominium, respecting the spaces in front of external houses, and parking is allowed starting from the office onward. Only in the case that the visitor uses the house without the owner's presence can they bring their vehicle, for which they must bring a written authorization from the homeowner (a format will be available for this case, which can be requested from the administration and sent by email or through the guest). Likewise, the guest must bring the remote control to open the vehicle access gate, as there is no personnel to open and close this gate.

Penalties

In everyday coexistence, due to carelessness or clumsiness, it is common to make mistakes that are normally unintentional but still cause annoyance to those affected.
However, sanctions cannot be treated equally or with equal magnitude; everything depends on the seriousness of the event.
In order to be fair when sanctioning a misconduct or an offense causing damage to another's property, it is convenient to categorize such violations.
Minor offense (causes annoyance but no damage): Written warning inviting the condo owner to correct their behavior (administrative sanction), with no financial penalty.

- Playing loud music.
- Using inappropriate language.
- Not notifying about visits or lending their houses (in advance).

Moderate offense (causes damage to another's property or a person): Obligation to repair the damage and a penalty payment of one to three months of the monthly fees. Repeat offense (minor or moderate): In case of a repeat offense, a penalty of one to five months of maintenance fees will be imposed, and the damage must be paid if it exists. A written notice should mention the recurrence, inviting the offender to correct their behavior and warning that further offenses will be sanctioned more severely.

Serious offense: The sanction for this type of offense should be evaluated by the executive committee, and if the severity warrants it, it should be considered by the assembly. The obligation to pay for damages and a fine ranging from three months to one year of maintenance fees should be imposed.

- Aggression by a pet towards a third party.
- Minors in the pool without adult supervision.
- Minors without appropriate diapers.
- Putting pets in the pool.
- Damage to someone else's property.

Regarding sanctions for violations or non-compliance with the regulations, whether administrative or financial, they must invariably be communicated in writing to the offender and the villa owner, immediately or as soon as possible. Individuals who are physically or morally affected, offended, or harmed in their property or person by a violation of the regulations by any condo owner, visitor, tenant, worker, or any person within the condominium must report it immediately to the administration so that necessary measures can be taken promptly. In case it occurs outside office hours and the case is considered serious, security personnel on duty may be contacted in the event of any anomaly or violation of the regulations. Security personnel have the authority to draw attention to or seek support from the authorities to correct any anomalies or violations of the regulations.
