Construction & Growth in Puerto Vallarta

Neither PVRPV or property owners or their representatives shall under no circumstance be held responsible for any disturbance, construction noise, dust/debris or inconvenience the guest may experience while occupying the vacation property. Whether this caused by the actions of the neighboring buildings, units within the same complex, construction, renovations, mandatory repairs, public service workers or unforeseen circumstances in the surrounding area, NO refunds, reimbursements, discounts or future credits can be issued. This would also include and is not limited to the closure of condo common areas for upgrades and / or repairs. These situations are completely beyond our control and are the result of robust and growing communities.

Due to the continued and constant investment, growth, upgrades and renovations in Puerto Vallarta, from time to time there may be a minor interruption of public services including hydro, water or sewer or the lack thereof. Although this is not a common problem in PV, it can happen.

Property Policy


- ALL properties represented by PVRPV are NON SMOKING this includes; patios, terraces, outdoor spaces attached to or a part of a Vacation Rental Property - if smoking takes place inside the property – you will be obligated to pay, a fine, an extra cleaning fee and you may be evicted.

- Clients shall not remove any item/s from the property, such as kitchen appliances, glassware, furniture, or any other item.

- The use and enjoyment of the property does not include illegal activities such as the use of illegal drugs, prostitution, selling of goods (illegal or otherwise) and/or kidnapping, this is strictly prohibited.

- Excessive noise that may affect neighbors will be strictly sanctioned as per the local building rules and regulations established by the property that you are occupying.

- PVRPV guests and/or the visitors of the guest(s) are responsible to adhere to the rules, regulations and polices of PVRPV and/or the individual property policies thereof. Failure to obey the rules and policies established will be asked to vacate the property without the right to any refund.

The responsibility to know or adhere to the policies, rules or regulations are the responsibility of the guest.

NO SMOKING
No smoking inside the property, the unit, on the terraces / balconies, or common areas.

OCCUPANCY POLICY
The minimum stay is 4 nights.
Maximum occupancy of 4 people in the unit.
The number of people stipulated in the reservation of the guests and in the electronic confirmation correo is the maximum number of people allowed to be placed on the vacation property. If you miss more information when booking confirmation, you may miss the occupancy. In case the check-in is allowed, an additional cargo can be applied.

VISITOR POLICY
It is prohibited for renters less than 30 days to have visitors. Violation of this rule will result in a maximum of $5,000 pesos in first occurrence and $10,000 pesos in second occurrence.
The number of visitors must not exceed the maximum occupancy of the unit.
Only the registered and confirmed guests can be covered by the unit.
We do not allow visitors to pass at night.
Visitors cannot use local areas.

PET POLICY
Sorry, no pets allowed.

NOISE RESTRICTIONS
NO HIGH VOLUME or NOISE between 10:00 pm until 9:00 am, including Speakers, Music, Televisions, etc. inside of the unit.

POOL POLICY
Please refer to the section "ROME ENCORE CONDOMINIUM REGULATIONS"
Pool hours from 9 a.m. to 11 p.m.
The use of the POOL is at your own RISK.
NO glassware in the pool or around the pool. PLASTIC glasses and stemware only.
NO Pool Parties.
NO Running around the pool area.
NO Urinating in the pool. Please use the washrooms in the room next to the pool.
PLEASE SHOWER or RINSE prior to using the pool.
Children under 16 years of age must be adults with them in the swimming pool.

GUEST KEYS
You will be issued 1 set of keys for each person noted on the Booking Confirmation. Keys must be returned in the same condition as received at the time of CHECK OUT.
PLEASE NOTE: Should you lose a set of keys the cost is $50USD ($1,000 pesos) for each lost-unreturned or damaged key or set of keys. Please have this fee prepared to be collected by the concierge at the time of check-out. This Fee is NOT covered by the guest damage insurance.

REGULATIONS OF THE ROMA ENCORE CONDOMINIUM

The provisions of these regulations aim to govern the establishment, modification, organization, operation, administration, and termination of the condominium regime in its vertical form, as well as the rights and obligations of the condominium owners. By the mere fact of being a condominium owner, tenant, occupant, or visitor of any residence, the following obligations are incurred, regardless of those that may arise by order of the Condominium Assembly.

Rights and obligations of the condominium owners regarding common elements:

Respect and comply with these regulations, as well as the municipal Building and Ecology Regulations and any other regulations that apply to peaceful coexistence.
Each condominium owner may use the common property and enjoy the general services and facilities according to their nature and ordinary destination, without restricting or making it more onerous for others to exercise their rights.
Take responsibility not to lease, lend, or transfer possession of their residence to persons who:
Endanger the peace and decorum that must be observed in the condominium.
Do not accept to fully respect the Regulations, by presenting themselves to the administration to sign the acceptance and receipt of these regulations.
Do not store machines that, due to their size, number, or nature, represent a threat to the safety and aesthetics of the condominium and its occupants, as well as dangerous, flammable, or illegal substances.
Owners or tenants, as well as their family members or visitors, have the obligation to comply with the rules established in these Regulations. In any case, the owners are responsible for the actions and conduct of their visitors and dependents (drivers, bodyguards, service staff in general, etc.). These dependents may not use the common areas of the building or remain within them.
It should be considered that anyone over the age of 6 is considered an occupant. Owners who exceed the maximum occupancy limit will have to pay a penalty of 2,000.00 pesos per person per night.
Observe moral and decent conduct within the condominium, urging family members, friends, visitors, guests, and/or employees to behave in the same way. The condominium owner is responsible for the behavior and actions of the aforementioned individuals.
Condominium owners will notify the administration if there are lease agreements, as well as their duration, and should ideally send notice with at least 24 hours' notice before the arrival, including the names, number of guests, and check-in/check-out dates for general control.
When guests come to stay at the condominium during the owner's absence, it is necessary to send written notice of the number of people, the responsible person's name, and the dates they will be using the unit. This must be directed to the administration ideally 24 hours before the arrival date of the guests.
Dispose of trash in the designated trash room located in the interior parking lot of the condominium, in sealed bags. Under no circumstances should trash be placed in hallways or at the entrance door. Glass should not be included in the bags; it should be taken personally by the owner to the designated trash room to avoid accidents during handling. Likewise, recyclable materials such as cardboard, wood, and packaging from purchased items, which could block or saturate the trash room, should be disposed of properly.
Inform tenants, occupants, and visitors of their residence about all the obligations and rights they acquire within the condominium to ensure full compliance with these regulations.
Obligations

Take necessary measures to avoid accidents, disasters, contingencies, or thefts in your homes.
Use the private area and dwelling of which you are the owner exclusively as a residence, and no other use is allowed.
Do not produce noise, sounds, disturbances, or odors that threaten the peace and comfort of the Condominium. Do not circulate toys or any type of equipment that generates noise in the common areas of the condominium.
Prevent leaks and drips that affect your neighbors. If they occur, you are obligated to make the necessary repairs immediately.
Prevent gas and water leaks and, if they occur, notify the administration and relevant authorities immediately to avoid disasters within the condominium, as well as make repairs without delay. If you are not present in the dwelling, the administration is authorized to take the appropriate measures and, if necessary, enter the private unit, ensuring the safety and integrity of other owners and their property, as well as common property.
All condominium owners must maintain their respective private units and insure them for their full value against fire, earthquakes, explosions, or any other disaster that may endanger them, covering the premiums incurred.
No activity that is dangerous, unhealthy, or disturbing may be carried out. Each owner must have a fire extinguisher for all types of combustible or flammable materials within their private unit and take the necessary measures required by the Civil Protection Law for each case.
Condominium owners cannot change, modify, paint, decorate, or alter in any way, even minimally, the exterior parts of their private units, including finishes, walls, ceilings, doors, handles, hinges, varnish colors, paint, textures, etc., unless these modifications are agreed upon by the other owners, or are for required maintenance to preserve them in good condition and appearance.
Regarding balconies, owners cannot make any modifications to the structure or use of these.
No occupant of the property can obstruct or block entrances and passages, leaving any objects that hinder the movement of people, as these services are for common use.
Each condominium owner can use and dispose of their unit with the limitations and prohibitions established in the Civil Code of the State of Jalisco.
Prohibitions

Condominium owners and, in general, occupants of the condominium may not, except with the consent of the General Assembly and in accordance with applicable laws:

Engage in any action that affects the peace and comfort of other owners and occupants, or that compromises the stability, safety, or health of the condominium, nor engage in omissions that produce the same results.
Carry out actions inside or outside their private unit that prevent or render ineffective the operation of common services and general facilities, or that limit or hinder the use of common areas, or jeopardize the safety or peace of the owners or occupants.
Perform work or repairs during nighttime hours, except in cases of force majeure.
Cut down or transplant trees, or change the use or nature of green areas.
Modify, alter, or destroy common areas.
It is forbidden to use the services of condominium maintenance staff for tasks other than their function. Therefore, all owners must refrain from offering gratuities to employees in exchange for services other than those related to their duties.
Install curtains on the exterior view, corridor, or facade in colors other than beige or white. Place decorative items like pots, plants, pictures, etc., on corridors or facade walls.
It is forbidden to hang clothes, sheets, towels, rugs, etc., on balconies or in corridors.
Do not make connections or wiring visible from the outside; do not nail, screw, hook, or peg anything outside your private property, or even inside if it affects neighboring units.
It is strictly forbidden to walk around naked or topless and engage in exhibitionism. Any violation of this clause will incur a fine of $2,000.00 pesos for the owner and a total restriction to the building for the person identified by cameras.
It is strictly forbidden for owners to introduce orchestras or musical groups or any live music into their homes; sound equipment must not be used at a volume that disturbs other owners.
Do not throw substances that are prohibited by municipal regulations into the drains, such as flammable, corrosive, or greasy liquids, among others.
Do not use parking spaces that do not belong to you.
The use of poisons, herbicides, and pesticides is restricted to domestic types and must be used under the owner’s responsibility and only within their private area.
Do not reprimand other owners, tenants, occupants, or visitors, or interfere with their activities in any way. Any complaints regarding this should be submitted to the Administrator.
Do not introduce substances, products, or instruments that put healthy coexistence at risk and that are prohibited by law.
Providers, service providers, domestic workers, and personnel hired for remodeling or modifications must adhere to the schedule established by the administration.
Access to the condominium will be restricted, and only visitors, family members, providers, and service providers who are authorized by the owner will be allowed entry.
In the entry to your private unit, you cannot place planters or decorative plants, and these will be limited to inside your property.
The use of electric, gas, or charcoal grills is strictly forbidden inside the units or on the unit’s terrace. Remember that there is a BBQ area on the roof for the owners’ use.
The violator of these provisions and others specified in this regulation and the Civil Code of the State of Jalisco, regardless of the penalties established in this regulation, will be liable for the payment of damages and losses.
Regulation Compliance and Penalties

Penalties for each violation of this regulation will be as follows:

Upon the first violation, the violator will receive a written warning from the assembly, administrator, or the Board of Administration, which will be delivered or sent to the registered address or via email, indicating the specific violation of this regulation. Before imposing any penalty, the violator will be granted the right to a hearing to present their case either in person or in writing within a 48-hour period. If they do not show up, an act will be recorded indicating they were duly notified, and the penalty will be imposed.
If the violation is repeated, the violator will be fined $2,000 pesos.
Upon a second violation, the violator will be fined $5,000 pesos.
After more than two violations, the violator will be fined $10,000 pesos.
If the owner fails to pay these fines, the administration is authorized to collect them through maintenance fees, which could cause a delay in payment and result in restrictions on services and access to common areas of the building.
If any owner violates the municipal construction regulations, the administrator and the Board of Administration will be authorized to inform the relevant authority.
Penalties will be charged to the owner in their account statement from the Administrator. If an owner, occupant, or visitor fails to rectify the violation within 30 days from the first written notice, the Administrator is authorized to take the following measures:
Suspension of services. The Administrator may suspend the services provided by the condominium to the department or departments belonging to the violating owner, occupant, or visitor, including the use of common areas.
Gym Use

In using the GYM, the following rules must be observed:

The gym's hours of operation are from 6:30 a.m. to 9:00 p.m. Monday through Sunday.
Wear appropriate sports clothing and footwear when entering.
It is mandatory to use a towel for sweat when entering.
For no reason is it allowed to enter or remain shirtless in the gym area.
Do not bring food into the area; if you need a drink, bring it in a plastic container.
Do not play or run inside the area.
Respect and take care of the area and its equipment.
Minors under 18 years old are not allowed access to the gym.
Each person is responsible for accidents or injuries resulting from improper use of the equipment and the economic consequences of them.
It is your responsibility to assess and verify your health status, as this will determine if you are fit for gym practice.
Do not remove or move equipment from the gym.
The use of speakers is prohibited; only personal headphones should be used.
After completing your routine, turn off the air conditioning and clean and rearrange the equipment used, as a courtesy to the next user.
Pool Use

The following rules must be observed in the pool and pool area:

Private use of the pool is prohibited.
The hours are from 9:00 a.m. to 10:00 p.m. Monday through Sunday.
Children under 8 years old must be supervised by an adult.
There is no lifeguard; therefore, use the pool at your own risk.
Music is allowed at levels that do not disturb other users of the common areas. If the music becomes a nuisance, the administration will ask to lower the volume, turn it off, or use headphones.
The administration will not be responsible for forgotten items.
Shower before entering the pool to remove creams, oils, ointments, sand, etc., to protect the pool water’s condition and health.
Strictly prohibited:

Making bonfires or parties.
Introducing food or drinks into the pool.
Running near the pool area.
Using the pool for bodily functions.
Throwing trash into the pool.
Entering with inappropriate clothing (pants, dresses, shorts, etc.).
Using the pool outside of permitted hours.
Introducing glass or aluminum objects.
Playing ball games.
Smoking in any common area of the building.
BBQ Area Use

In using the BBQ area, the following rules must be followed:

The hours are from 9:00 a.m. to 10:00 p.m. Monday through Sunday.
Private use of the area is not allowed.
Share the BBQ area with others if it has not been reserved for private use.
Use aluminum foil on the grease tray.
Clean the area after use (remove trash) and take it to the designated trash area.
Parking Use

Parking rules:

Parking is restricted to owners who have purchased a parking space. Owners must respect the spaces of other owners and cannot use unoccupied spaces.
Do not park campers, RVs, trailers, boats, or any type of mobile unit other than a car or motorcycle in the parking lot, whether permanently or periodically.

Our vacation was made so much more beautiful and enjoyable because of our experience with your company and the amazing apartment we were able to stay in during our time. The views were magical, the unit itself was lovely and had everything you could need to be more than comfortable. A beautiful home away from away experience.
